Is LightMachinery ITAR Registered?
This is one of the most common compliance questions we receive from U.S. defense contractors and government suppliers, and it deserves a precise answer.
LightMachinery is a Canadian company and, as such, is not registered under the U.S. International Traffic in Arms Regulations (ITAR). Instead, we are registered under Canada's Controlled Goods Program (CGP) — the Canadian regulatory framework that governs access to, and handling of, goods and technologies with defense and national security significance.
What Is the Controlled Goods Program?
The Controlled Goods Program is administered by Public Services and Procurement Canada (PSPC) under the Defence Production Act. It regulates Canadian organizations that examine, possess, or transfer controlled goods - items that correspond closely to those controlled under ITAR in the United States.
CGP registration requires organizations to:
- Conduct security assessments of all personnel with access to controlled goods
- Implement documented security plans and access controls
- Designate a Designated Official (DO) accountable for ongoing compliance
- Submit to periodic audits and inspections by PSPC
For U.S. suppliers and partners, CGP registration is the recognized Canadian equivalent of ITAR compliance and represents the same commitment to protecting sensitive defense-related technology.
The Canada–U.S. ITAR Exemption
Canada holds a unique position under U.S. export control law. Under 22 CFR § 126.5 of the ITAR, an exemption permits the export and temporary import of certain defense articles and services between the United States and Canada without an individual export license — provided the items are for end-use in Canada or for return to the U.S., and that all other regulatory conditions are met.
This exemption exists because of the deep integration of the Canadian and American defense industrial bases, and the recognition that Canadian CGP-registered organizations operate under equivalent security and compliance obligations. In practice, this means that U.S. prime contractors and government customers working with a CGP-registered Canadian supplier like LightMachinery can often do so without requiring a separate ITAR export authorization.
